  • Hate speech - any speech, gesture, conduct, writing, or display which is forbidden because it may incite violence or prejudicial action against or protected by a protected individual or group, or because it disparages or intimidates a protected individual or group.
  • Doe v. University of Michigan
  • Doe (1989) - hate speech is too vague
  • We are sympathetic,but the University needs to ensure equal learning/ education is equal for each individual student, such efforts must not be at the free expense of free speech
  • We have not been doing very well with these cases concerning hate speech
  • We have determined that the University could not seriously argue because of the fact that the policy was never made for the purpose of protected conduct
