  • This is unconstitutional as it is beyond the power of congress
  • Alfonso Lopez jr was a 12th grade student at Edison High School in San Antonio, Texas.  He carried an unloaded revolver into school to sell it to someone for 44 dollars.
  • Later that day he was confronted by school authorities and admitted to having the weapon.  The next day he was charged with violating the federal.
  • Lopez was tried and convicted but he appealed and was sent to the US Court of Appeals.
  • Lopez was found guilty and he appealed again and the Supreme court allowed the case.
  • In a 5-4 decision the Supreme court affirmed the decision of the Court of Appeals.
  • Lopez spent 5 years in jail, until they threw out his conviction.
