  • New York tried to give Aaron Odgen private access to use steamboats on the Hudson river.  Gibbons disagreed.
  • He thought that states could regulate that interstate transportation so he could use his permit
  • Gibbons thought that states didn't have the power to regulate transportation in states. 
  • Do states have the power to regulate commerce?
  • Chief Justice John Marshall sided with Gibbons and thought that Congress should have the power to regulate commerce, not the states.
  • It gave the federal government more power because they gained the ability to control interstate commerce.
