  • Miranda v. Arizona 
  • 1966
  • In Phoenix, Arizona, Ernesto Miranda was arrested for rape, armed robbery, and kidnapping. The police failed to read Ernesto his rights.
  • Why was Ernesto not read his rights?
  • Ernesto did not know that he could remain silent or have an attorney appointed for him, so he was incriminated without knowing all of his rights.
  • The state of Arizona tried to say that Miranda wrote a confession down so either way he could be prosecuted.
  • The Supreme Court ruled that detained criminal suspects, prior to police questioning, must be informed of their constitutional right to an attorney and against self incrimination.
