  • In 1963 in Phoenix, Arizona Ernesto Miranda was arrested for rape, kidnapping, and robbery. He was filmed during the 2 hour interrogation and in that he admitted committing the crimes.
  • You're right!
  • Ernesto was found guilty and sentenced to 20-30 years in prison.
  • Amendment 5 Amendment  6
  • He appealed the the Arizona Supreme Court. Ernesto claimed that the police had unconstitutionally gotten his confession. They disagreed. 
  • He is not offered these rights so he is going to get convicted.
  • In 1966 he appealed to the US supreme court that reviewed his case. In a 5-4 decision they decision that  the police couldn't use Ernesto's confession because they hadn't informed him of the right to an attorney and self - incrimination.
  • Ernesto's 5th Amendment right was forgotten.(Gives criminal right to self incrimination) As well as his 6th  Amendment.(Right to an attorney) 
  • Ernesto Miranda was not offered the "Miranda Rights" therefore his confession was unconstitutionally admitted at trial where he was convicted.
