Clarence Earl Gideon walked down Panama City with heavy coins in his pocket and a pint of wine.
Police suspected that he stole money from a pool hall's vending machine, so he got arrested.
Habeas Corpus Petition
At trial, Clarence requested an attorney to represent him. The judge denied his request and said that attorneys were only provided for poor defendants who could possibly result in a death penalty.
Clarence Gideon was sentenced to five years in prison.
He filed a petition for writ of habeas corpus in Florida Supreme Court, but the court denied his request. He then filed a handwritten petition in the Supreme Court of the United States.
