How does our government decide what punishes are ok to give people who break the law?
Well according to the 8th Amendment, there is a line between what that person specifically did to break a law and the punishment given.
The 8th Amendment states that "no cruel or unusual punishments shall be put into place." This also goes with the bail. No judge can legally give someone who ran a red light a death sentence or put five million dollars to get out of the punishment.
