  • I'm repealing the Judiciary Act
  • Give me my commison Mr.Madison!
  • No! Take it to the Judge.
  • Mr. Marshall I demand my commison from Mr.Madison.
  • I'm sorry sir but if I were to give you a Writ of mandamus the Jefferson Adminastration would ignore it.
  • We have came to the conclusion that Marbury should have received his commison. But Madison is not required to because, the constitution says the court doesn't have the power to make this decision. 
  • The supreme court could declare acts of congress, and by implication acts of the president, unconstitutional. They can do this if they exceed the powers of the constitution. But the most important is that the court became the arbiter of the constitution, the final authority on what the document meant.
  • The importance of Marbury is the assumption of Several powers by the supreme court.
  • The Judiciary act was ruled unconstitutional.  We have used our powers to expand individual rights. Marbury vs Madison gave the court more power than they had previously. This power has helped America develop.
