  • in 1966, Ernesto Miranda was arrested for committing a violent crime.
  • After the police interrogated him for two hours, they made him sign a typed paragraph saying his confession had been made voluntarily.
  • I was never told about my right to remain silent!
  • The paragraph stated; "with full knowledge of my legal rights, understanding any statement I make may be used against me."
  • Miranda was taken to court, but he knew what the 5th amendment states.
  • he argued that he did not sign the paragraph voluntarily and he had not been told his right to remain silent. He was not told about his 6th amendments rights to a lawyer.
  • Because of Miranda's 5th amendment rights being violated, the court reversed his conviction.
