We are taxing your bank.
your state may not tax my national bank.
As a state we may tax any business in our state.
As a national bank we are no ordinary business. they cannot tax us.
As the judge my decision is the final word. in this case McCulloch vs. The state of Maryland. I decide in favor of McCulloch and the national bank.
The judges decision that day was based off the supremacy clause of the constitution. The state wanted to use taxes as a way to get rid of the national bank. with the power to tax comes the power to destroy. therefore the judges decided the bank could not be taxed.
