  • John Adams-Lost 1800 Presidential Election Federalist
  • Thomas Jefferson-Won 1800 Presidential Election Democratic-Republican 
  • Judiciary Act-Article III of the Constitution established a Supreme Court, but left to Congress the authority to create lower federal courts as needed.
  • Chief Justice Ellsworth -I would like to resign John Adams-I appoint John Marshall as chief justice John Marshall(former secretary of state)
  • Last Minute Commissions
  • Don't worry I will have Madison hold them,one is for Marbury
  • we have been working all day
  • Sir it's almost too late and we have 4 commisions left
  • Marbury's Fight To Be A Judge
  • I want to be a judge, and the Supreme Court should not restrict me because my commission had already been created! Supreme Court also has the power to issue a writ
  • Marbury Is Unable To Get His Commission
  •  I turn down my claim. The Constitution did not give the Supreme Court jurisdiction to decide Marbury’s case.  That meant the 1789 law passed by Congress was unconstitutional.  Therefore, the Supreme Court said it could not help Marbury get his commission.

  • This is the first time I have seen judicial review being used!
