time frame 1801-1803
The Federalists wanted to continue power over the judiciary branch so they passed the judiciary act of 1801, which increased the number of federal judges.
President John Adams gave out commissions to four men. They were signed by the president and approved by the Senate.
I am issuing a writ of mandamus and telling you not to give out those commissions.
When Jefferson became president he told Madison not to give out the commissions. This led to Marbury suing Madison. In a way this put Jefferson above the rule of law.
