  • time   frame 1801-1803
  • The Federalists wanted to continue power over the judiciary branch so they passed the judiciary act of 1801, which increased the number of federal judges.
  • President John Adams gave out commissions to four men. They were signed by the president and approved by the Senate. 
  • James Madison
  • Thomas Jefferson
  • I am issuing a writ of mandamus and telling you not to give out those commissions.
  • When Jefferson became president he told Madison not to give out the commissions. This led to Marbury suing  Madison. In a way this put Jefferson above the rule of law.
