  • Dred Scoot was the slave of Dr. John Emerson
  • Scott's case reached the U.S. Supreme Court after 11 years
  • African Americans, whether free or slave are not citizens under the U.S. Constitution
  • This means that you do not have the right to file a law suit in federal court
  • But then Doctor John died
  • Also, you're residence on free soil dose not make you free due to the fact that you returned to the slave state of Missouri
  • Your status as a free or slave depends on the laws of Missouri
  • In 1864 Scott sued for his freedom in Missouri state, arguing that he had become free when he lived in free territory
  • Under these retraction you can not be free
  • The Missouri Compromise restriction on slavery north of 36 30 to be unconstitutional
  • Under this ruling of congress had no right to ban slavery in any federal territory
  • The justices, which were mostly from the south, had three key issues The court had to rule on whether Scott was a citizen
  • The court had to decide if his time living on free soil made him free
  • The court had to determine the constitutionality of prohibiting slavery in parts of the Louisianan Purchase
