  • I do believe that I have a commission awaiting me!
  • Marbury goes to see Jefferson about his commission.
  • False. I am president now and I do not want you as my judge! You are dismissed.
  • Jefferson and his new secretary of state Madison discuss the commission problem.
  • Am I even required to give those Federalists their commissions?
  • Absolutely not! Marbury thinks he can get his commission by suing ME? We'll see about that...
  • *In court*
  • I deserve my commission! Judge Marshall, you must issue a writ of mandamus!
  • No. Adams' term ended and now I am in charge of the executive branch.
  • Judge Marshall discusses the situation with the court.
  • Can I even issue a writ of mandamus? Does the Supreme Court have the authority to order the delivery of the commission?
  • No. The Judiciary Act of 1789 gives SCOTUS more power than Article III.

  • The court has ruled that the Judicial branch does not have the right to exercise original jurisdiction. The Supreme Court may only exercise judicial review in order to keep the other branches constitutional.
