Thank you for the presentation on the Delegation of Authority, I found it quite informative. I need some advice on a Contract I am managing and hope you can assist me.
Well you see John, I have a contract where the works is far from complete however my completion date is the end of month. My Delegation Consent Form is also expiring like the contract. I have started to modify my contract through our governance procedures for the Extension of Time but I fear that I will not be on time.
I will gladly assist where I can, please give me some details

Good Question John, there has been no delay from the Employer. The Contractor is just not performing hence he is unable to meet his milestones. We have not received any EOT claims and if we did it would assessed at zero. So if I do not extend the contract timeously, the contract will expire and I will be unable to affect payment
Aah I see Julie this is quite a pickle you are in. However it is very simple to resolve. Firstly the contract does not expire. If there is no EOT claim then the Contract completion date does not need to be extended. The Contractor must complete his work as per his revised schedule and the Employer MUST impose Delay Damages
