  • Today we will be learning about the Marbury vs Madison Supreme Court Decision
  • This is important for our history because it gave the Supreme Court Judical Review
  • This decision was important to our history because it gave the Supreme Court Judical Review
  • On February 24, 1803 Chief Justice Marshall was the first to declare an act of Congress Unconstitutional
  • Unfortunately, Madison didn’t know he was appointed and by the time he found out, Jefferson had already took office and appointed another justice in his place
  • All of this occurred because before President Jefferson took office, President Adams appointed a justice named William Madison
  • He wanted the Supreme Court to issue mandamus so he could regain his position
  • Madison believed he should have been given the justice position because Adams appointed him before he left office
  • Thus setting the precedent for Judical Review
  • Chief Justice Marshall didn’t commission the mandamus because the Constitution didn’t give that power to the court
  • Chief Justice Marshall denied the mandamus because the constitution didn’t give that power to the Court
