Storyboard Text

  • I want to speak with my lawyer now!
  • 1964
  • Chicago Police Department
  • Danny Escobedo keeps requesting to speak with his lawyer
  • Well he can stop asking cause he's not going to get it. He was arrested for being accused of murder and he pretty much confessed to it.
  • You're violating my rights!
  • Was Danny Escobedo denied the right to counsel as guarenteed by the sixth ammendment?
  • The police ignored my requests to speak to my lawyer and failed to inform me of my rights to remain silent. Now I'm found guilty of murdering someone.
  • The right to assistance of counsel should not attach until the formal institution of proceedings by indictment, information, or arraignment, and that the majority's holding would have an unfortunate impact on the fair administration of criminal justice.
  • Escobedo Rule holds that individuals have the right to an attorney when an investigation goes beyond a general inquiry and focuses on a particular suspect. This principle states that a statement by a targeted suspect who is in police custody is not admissible at trial.
