  • Thomas Jefferson is the new President of the United States
  • This is NOT good for the Federalist party.
  • Excellent idea President Adams!  That way the Federalists will maintain control of the Judicial Branch even with Mr. Jefferson becoming President.
  • Before Thomas Jefferson becomes the President I am going to appoint many new justices in the District of Columbia!
  • Okay, Mr. President.
  • I am passing the Judiciary Act of 1801.  Don't hand out the commissions for the new judges in the District of Columbia.
  • I am very upset I didn't receive my letter appointing me to my judicial position.  I am going to issue the Supreme Court, a mandamus aksing why not! 
  • Chief Justice Marshall, What are we going to do?  Jefferson is weakening our legal judiciary powers.
  • The questions I need to answer are does Mr. Maybury have the right to petition the court, Did The Laws of US courts allow Maybury to grant the petition, and could the Supreme Court issue a legal order.  I find that he does have the right, and how dare Thomas Jefferson ignore my ruling!
  • Maybury had legal rights to the commission . It is also the court's job to protect the individual's rights .  The courts needs to fix the situation of Maybury not getting his appointment. How are we going to do this?
  • As Chief Justice I am going to need to be very careful.  I am going use the Judiciary Act of  1789 which will give this court the power to issue writs of mandamus and Acts of Congress.   
  • It is also the job of the Supreme Court to protect a person's individual rights against the President of the United States.  The courts are the third branch of the government with the Senate and President. 
  • Cheif Justice Marshall this is a brilliant decision.  Even the President can be found unconstitutional if his acts exceed the powers of the Constitution.  Our court will be seen as the power that upholds the Constitution.  Well done!
