Hi Sarah, can you meet with John Smith. He is a self-employed physiotherapist who works from his house. He has been charged with two counts of indecent dealings with a child under 16.
Hi Peter, I heard about Mr Smith on the news this morning. It’s attracted a lot of media. It’s my understanding that Mr Smith touched a teenage girl inappropriately during their treatment and secretly recorded them whilst they got changed. Is that correct?
Yes, that is correct. He will be coming in at 2pm today and has requested that a female represent him because he feels it would be a better look for his case.
Ok. I will meet with him, but I have to say that anyone who that takes advantage of a child like that disgusts me. I guess that’s the con of being a lawyer, having to represent people that hurt children.
Hi John, my name is Sarah and I’m an Associate here at Justice Legal. I have been briefed regardismy understanding you have been charged with indecent dealings with a childunder 16 by way of inappropriate touching and secret recordings.
It’s possible I may have accidentally touched her too close to her breasts, but she never said anything at the time, so I thought it was fine and I didn’t know my laptop was recording.

How close to her breasts did you touch her? How did you not know your laptop was recording? I assume you would have had to press 'record' at some stage that day.
How close to her breasts did you touch her? How did you not know your laptop was recording?
It’s been so long since it happened, but I’d say it would have been close to her collar bone because she had a shoulder injury. I now recall that I had been recording a tutorial for an exercise earlier that morning, I must have forgot to turn it off.
I havo it.
It’s alleged that you touched her whole breast and there was no tutorial recorded prior to her appointment. It’s also noted that that your laptop was positioned in a way to only see a person’s shoulders to knees.
And why do you claim it's not true? what is your version of the events?
I know it looks really bad, but I didn’t intend to touch her inappropriately touch her or record her getting changed. I will not plead guilty!
Thank you! I didn’t do this, I promise. As a woman, surely you can believe this? you can see I'm just a normal guy.
These are serious charges, but the firm has decided to take on your matter. We will also have to engage a Barrister to assist your case and represent you during the trial.
We have received the Police brief today which alleges that although the parent was present, you were inappropriately touching the minor whilst under the sheet, so it could not be seen, and then left your laptop in the room recording whilst they changed.
