Terry! You report to the principal's office and hand over your cigar.
Terry, you are now under arrest.
I AM TERRY'S MOTHER, AND HOW DARE YOU!! I SHALL BRING YOU NOW!!!
Terry (T.L.O.) was found smoking in her high school bathroom. The school also searched her locker and found drugs.
Speak your case!
I represent the school district of Piscataway, New Jersey.
I represent T.L.O also known as Terry.
Terry was arrested possession of marijuana. The principal also found a pack and cigarettes in her purse and admitted to selling them in school.
Terry's mother decided to bring the school to court because she believed that they were violating Terry's fourth amendment rights because they searched Terry's purse and she believed that is was unreasonable search and seizure.
The Supreme Court sided with the school. The school had the right to check Terry's purse because part of the school's job is to maintain a safe place for learning. The school had a reasonable suspicion to look through Terry's purse.
Today, students no longer have their 4th amendment rights. If a teacher has a suspicion, they have the right to invade the student's privacy.
