  • I have to leave office tomorrow... but I can still appoint people today.

  • Hello, William Marbury. I have decided you will be the new justice of the peace. The new president should go through ALL the official channels later.

  • Hey Mr. Jefferson you're the new president right? I was appointed to be justice of the peace and was told you would finish finalizing it.
  • Talk to James Madison, Secretary of State.
  • In the last days of his presidency, John Adams appointed many people to fill positions.
  • You can't have the job, president's orders.
  • One of which was William Marbury.
  • Supreme Court
  • 1803
  • Chief Justice Marshall! A writ if mandamus! Do that, it will MAKE them give me my job.
  • The nominations were not officially finalized. Thomas Jefferson did not want them to be either.
  • Therefore, James Madison would not allow William Marbury to take the job.
  • I'm gonna go to the Supreme Court.
  • Try it!
  • Marbury took it all the way to the Supreme Court but still could not get the job.
  • Actually we can't because the opinion of the court was that the Judiciary Act of 1789 is unconstitutional. Sorry its this new thing called judicial review.
  • Judicial review was used from then on out.
