  • This noise from the airport has to stop! My chickens are stressing out!
  • I have lost 150 chickens already! if i lose anymore i will have no choice but to stop farming
  • And that he did, the noise from the airport was too much for farmer Thomas Lee Causby, that he and his family had to abandon the business.
  • Causby sued the United States, arguing that he owned the airspace above his farm.
  • thus violating the Takings Clause of the Fifth Amendment.
  • By flying planes in my airspace, the government has confiscated my property without compensation.
  • The United States Court of Claims accepted Causby's argument, and ordered the government to pay compensation.
  • Given the damage caused by the particularly low, frequent flights over his farm, the Court determined that the government had violated Causby's rights, and he and his family got their farm back.
