Do we have the right?
As supreme court justice, because we have the power of judicial review we should change the law so it is not misinterpreted.
Judiciary Act of 1801 can be interpreted yes, but the constitution says we don't.
So that means that section 13 is unconstitutional.
Because the issue was not coming from a lower court, we can not take the case. Also section 13 can be interpreted that it is lawful to take the case, it unconstitutional.
That is why we should use the judicial review, to rewrite the law.
Also we set the judicial review.
Thank goodness that is over.
Now we are not on Jeffersons bad side.
