  • "But the president said I could be a Judge!"
  • Yes, Sir.
  • The Argument
  • Let's go ask Jefferson what went wrong with the letters than.
  • Wasn't Madison supposed to send out the letters to those who got the jobs?
  • I did not get my letter to know that i got the job!
  • Jefferson had told us that the jobs were already full.
  • I want my job to be a judge but Jefferson never give me a letter even though he said I was fit to be a judge.
  • The Decision
  • I had Madison to deliver the letters, but by the time Madison passed them out all the jobs were full.
  • Then there is no need of a court order.
  • Do not hand these letters out to the people who got the jobs.
  • Adam's wanted to give out the jobs , but it was to late Jefferson had became president and never gave out the letters for the jobs and had made Madison to only give out letters to his supporters.
  • So what?
  • Marbury went to the supreme court ,and the Supreme court told him that Congress had passed a law stating the you can not start at the supreme coort if all you wanted was a writ of mandamus.
  • The supreme court agreed Marbury had a right to receive his commission, but the court had disagreed and had the power to issue the writ. Therefore, the supreme court said it could not help Marbury get his commission.
  • The decision in Marbury vs. Madison helped cement the judicial branch as equal with the other two branches of government by giving it equal power.
