  • Madison's Idea
  • MADISON: Federalists need to have the power. I'll just appoint a bunch of Federalist members to be judges.
  • Conflict Between Marbury and Madison
  • JEFFERSON: What is this? Madison! Do not send those letters!
  • Yes, sir!
  • Solution: Judiciary Review
  • COURT: No! Our system now is Judicial Review. We can declare laws and actions of other branches.
  • MADISON: I have to turn in Marbury's last minute commissions.
  • John Adams lost the election against Jefferson (Anti-Federalist) Madison was trying to find a way to keep the Federalists in power. So he assigned Federalist members as judges.
  • When Jefferson got to office, he was angry. He told Madison to not send the letters. When Marbury didn't get the letter he went to the supreme court to make them send him the letter, they refused. 
  • The supreme court made Judicial Review, this means that the court can declare laws and action of other branches.
