Storyboard Beskrivelse
This comic shows Actus Reus and Mens Rea in the form of willful blindness. In the comic, Barry is paid by a suspicious stranger and agrees to deliver a backpack given to him by them that actually contains illegal drugs. The Actus Reus in this case would be drug trafficking because Barry is delivering the backpack full of illegal drugs. Barry does not know what is inside the backpack but he suspects it could have something illegal inside of it yet he decides to deliver it anyways. This demonstrates Mens Rea as Barry thought that what he was doing was illegal but still did it anyways. Barry can be charged with drug trafficking based on section 5 of the Controlled Drugs and Substances Act and Possession of Property Obtained by Crime under section 354 of the Criminal Code because he possesses drugs that were obtained illegally and he is delivering them to someone.
Storyboard Tekst
- Can you deliver this to 66 Crime Drive? I will give you $300.
- Barry is asked to deliver a backpack by a suspicious person. He agrees without checking the contents of the bag.
- Ok. I will do it
- Uh...
- Barry is stopped by the police who have been following the suspicious person's whereabouts. They ask to search Barry's car and Barry reluctantly agrees.
- Can we search your car?
- There are drugs in this backpack!
- I didn't know!
- The police find illegal drugs in the backpack and arrest him. Barry states that he didn't know the contents of the backpack.
