When Thomas Jefferson was sworn into office he told the Secretary of State, James Madison, to not deliver the commissions. One of the men appointed, William Marbury, was mad. Marbury wanted the Supreme Court to order Madison to show why he couldn't get his commission.
why can't I get my commission already???
We don't have the right to force him!
Chief of Justice, John Marshall ruled that Marbury had the right to get his commission. He also ruled that the Supreme Court didn't have the right to make James Madison give the commission to him.
John Marshall referred back to the Judiciary Act of 1789. This act gave power to ruling cases like Marbury's. Marshall said that Section B of this act violated the Constitution because it gave powers to the courts that the Constitution says it shouldn't have.
A law repungnant to the Constitution is void.
The Supreme Court judicially reviewed the act. For the first time ever the Supreme Court declared a law unconstitutional. Through this the Supreme Court defined its role in our emerging nation. They defined themselves as a branch of government equal to and independent of Congress and the Executive branch.
This insignificant court case lead to a very important statement for our young country. In conclusion, the case of Marbury vs. Jefferson was very important in the shaping of our government.
