Years go by since case began...
I John Marshall, Chief Justice of the Supreme Court declare that Marbury has a right to his commission. However, because of the Judiciary Act of 1789, we cannot give him his commission. Therefore, I establish JUDICIAL REVIEW.
Judicial Review is the power of the Supreme Court to declare Acts and actions by Congress UNCONSTITUTIONAL. This means that if the Congress does something that is in opposition to the Constitution, the Supreme Court has power to check the Congress.
What is Judicial Review?!?!?!?!
Before Judicial Review, Congress was a branch with no power. The Executive Branch could easily boss around the Judicial Branch which rendered them useless in the process of Checks and Balances. Also, Congress was an extremly powerful force that could hardly be checked. So, Judicial Review allows them more power of the Esecutive and Legislative Branches which adds to one of the foundations of American Governmnet: Checks and Balances
