  • After repealing the Judiciary Act of 1801, lots of people were upset because they didn't receive their commissions to be judges. One of them was William Marbury. He decided to sue James Madison, the person supposed to deliver the commissions.
  • You didn't deliver our commissions! I'm suing you!

  • Well, because this act is unconstitutional, the Supreme Court can't make him do anything.

  • Marbury petitioned the Supreme Court to force Madison to deliver the commissions, citing the Judiciary Act of 1789. John Marshall, the chief justice, said that this act had exceeded the authority of the Court, and ruled the act unconstitutional, so it could not be used.

  • This case was critically important because it gave new powers to the Supreme Court. One was the power to declare acts of Congress unconstitutional if they exceeded the powers given by the Constitution. Most important of all, the Supreme Court became the arbiter of the Constitution, meaning it has the final authority to interpret the meaning of the Constitution. The third change was the creating of Judicial Review. This allows the Court to review any law or act to determine if they are following the Constitution.
