- To prove defamation there must be (1) publication, (2) of a defamatory statement, (3) that identifies the plaintiff, (4) that is false, (5) that is published with the requisite degree of fault, and (6) that damages the plaintiff's reputation. (actual malice required here- celebrity)
- After determining that all of the requirements were met, the celebrity and attorney decided to take the matter to court

It has been determined that the defendant acted with actual malice because he knew the statement wasn't true and harmed her reputation, as evidenced by her inability to gain employment.
