  • How does Marbury v. Madison play a big part in the U.S. government?
  • Adam loses Jefferson and appoints mid-night judges so that federalists will still have power in the government.
  • Jefferson becomes president and finds the appointments. He ordered Madison, his secretary of state not to deliver the appointments.
  • William Marbury was supposed to be a judge, however, his paperwork was never delivered. To get his position, he brought the case to the supreme court and asked them to issue a writ of Mandamus.
  • The Writ of Mandamus is a power given to the Supreme court by the Judiciary Act of 1789 where they can order a government official to fulfill a duty.
  • John Marshall, a Federalist appointed by President Adams, was the Chief Justice at the time.
  • Even though he could've issued the writ of Mandamus and give his political party advantage in the court, he did not want to disappoint the president. After looking at The constitution, John Marshall declared that the Judiciary act of 1789 was unconstitutional and developed Judicial Review.
