  • Roe was a pregnant women in dallas county Texas who sued Wade for Violating multiple amendments in the Constitution
  • Wade’s side was based off of how abortions can be harmful to the mother of the child and how it should only be done if the mother will have complications during the birth of the child.
  • Roe Argued that Abotion should be Legal and that what Wade said is against multiple amendments of the constitution, and that a woman should have a choice in this because it is their bodies, this shouldn’t be determined by men
  • Wade lost this because his side of the argument was deemed “Unconstitutional”. “A woman’s right to choose to have an abortion was not considered an absolute right. The Court stated that government restrictions on a woman’s right to choose were subject to the highest standard of review, that of strict scrutiny. This level of review requires that in order to be enforceable, a government regulation of this right must be shown to be narrowly tailored to meet a compelling state interest.” Roe won the support of the Supreme court with a 7 - 2 win.” The majority determined that a woman’s right to decide whether to have an abortion involved the question of whether the Constitution protected a right to privacy.”
