  • Does a public school requirement that students participate in a nondenominational prayer violate the First Amendment's Establishment Clause, as applied to states by the Fourteenth Amendment?
  • In 1962, Michael Engel was a student that adopted a prayer due to his school requirements. His father, Steven Engel protest the prayer. He and a few other parents argued that the school-sponsored prayer violated the establishment clause of the First Amendment. When the Board ignored their petition, the group of parents filed a law suit, ultimately creating the Engel v Vitale Court case.

  • In 1951, the State Board of Regents of New York composed a non-denominational prayer for public schools to recite each morning. Students were given the option to participate in the prayer of leave the room. This would prevent the forced religion views on students.
  • The majority of the public agreed that requiring students to participate in a religious prayer is unconstitutional and fights the First Amendment rights.
  • The establishment clause was only meant to prohibit the establishment of a state-sponsored church.
