Does a public school requirement that students participate in a nondenominational prayer violate the First Amendment's Establishment Clause, as applied to states by the Fourteenth Amendment?
PLAINTIFF ARGUMENT
The prayer is contrary to our and our children's religious beliefs, and it's a violation of the First Amendment Establishment Clause, applicable to New York by the Fourteenth Amendment.
DEFENDANT ARGUMENT
The prayer is published as part of the "Statement on Moral and Spiritual Training in the Schools" and its use is recommended in schools. Reciting is is optional.
MAJORITY OPINION
Requiring public school students to participate in religious prayer is unconstitutional, and daily recitation of the Regent's prayer is inconsistent with the First Amendment's Establishment Clause.
DISSENTING OPPINION
The Court misapplied a constitutional principle in denying children the opportunity of sharing in the spiritual heritage of our nation.
