- Defendant's Argument:Vitale argued that the school had power to use the non denominational prayer as a part of daily procedures.
- The Majority decision stated that the policy of a required daily recitation of the Regents' prayer is inconsistent with the Establishment Clause of the First Amendment.
- The Dissenting opinion was that the majority opinion misapplied the constitutional principle and denied school children of the opportunity of sharing in the spiritual heritage of the nation. The Justice also gave examples on how the government always fosters religion.
