- Dartmouth should be a public institution instead of being private
- Absolutely Not, this is a private institution under a charter established by King George lll in which that it was to be a private, and not public school of higher education
- The legislature of New Hampshire invalidated Dartmouth's charter to convert the school from a private to a public institution in the state court
- Dartmouth refused to give up and brought the case to the Supreme Court
- Dartmouth’s charter constituted a contract that New Hampshire had violated this contract in attempting to replace the original trustees
- Also the charter is a contract so legally New Hampshire can not make Dartmouth public so the institution remains private
