Should students have free speech? Is this even considered free speech?
Mary Beth Tinker pleading for her rights
Argument for the petetioner
Why us students are protected through the First Amendment
Students sued their school for not allowing them to wear armbands used to protest against the Vietnam War, saying it violated their first amendment rights to free speech
Arguments for the Defendent
Do students have the right to "free speech" guaranteed in the first Amendment? Is wearing armbands considered free speech?
Decision
The court has ruled against Des. Moines independent school District!!!!!
Mary Beth Tinker argued that the first amendment protected free speech through that amendment. She believed that even on school grounds, students have their rights that cannot be taken away from them
The defendant argued that students should not have free speech on school grounds. They later went on to explain how school has rules that should be followed, and that the first amendment never applied to the students as well
The U.S Supreme Court rules that students have the same rights to free speech as all other citizens. they ruled that armbands are a symbol of speech, that therefore could not be taken away those rights
