Emily Murphy was challenged by a male lawyer asserting she was not a "person" under the 1867 British North America Act.
You are not a "person"
this meant that women were not eligible to hold appointed office which led to the creation of the famous five
The five Women who wouldn't resist until they were considered "persons" under the law.
Henrietta Edwards
Emily Murphy
Irene Parlby
Nelie McClung
Louise McKinney
In 1928, the issue was pushed to supreme court of Canada.
" we must be entitled to hold appointed public office"
A year later, the "famous five" took their case to the british privy council in london to be heard. after 3 months the privy council agreed with murphy.
to exclude women from appointed public office was a relic of days more barbarous than ours
the "famous five" had won the case and were awarded womens rights!
