  • I have been appointed Justice of the Peace by president Adams,b ut my commissions were not subsequently delivered. I am petitioning the government to force secretary of state, James Madison to deliver the documents.

  • Marbury's commissions had not been delivered by the time I became secretary of state, therefore, he could not be legally dressed a s a justice of peace, and the appointment could not be made.

  • The decision of the court in this case was that, Marbury, indeed had the right to his commission, but congress could not give the Supreme Court the power to issue an order granting Marbury his commission under the Constitution.
