  • The separation of power is distributed by 3 levels, the legislative, the judiciary and the executive. The legislative has the power to create an amend laws. The judiciary has the power to imply the laws and finally the executive has the power to put the law into action

  • The first of its principle states that “Judicial independence is a prerequisite to the rule of law and a fundamental guarantee of a fair trial. A judge shall therefore uphold and exemplify judicial independence in both its individual and institutional aspects.

  • A presumption of innocence means that any defendant in a criminal trial is assumed to be innocent until they have been proven guilty. As such, a prosecutor is required to prove beyond a reasonable doubt that the person committed the crime if that person is to be convicted.
