  • President John Adams, in the final days of his presidency, hastily makes a series of judicial appointments to secure Federalist control of the courts. He assigns John Marshall as Secretary of State, entrusting him with delivering the commissions. Adams' goal is to ensure that his party’s influence remains strong after his term ends.

  • I've been promised a position as justice of the peace! This is my chance!
  • These are the oppointments, but they weren't delivered before Adams left. There's still work to do.

  • John Marshall, now Secretary of State under President Thomas Jefferson, finds that many of Adams’ judicial appointments, including William Marbury’s, weren’t delivered before Adams left office. Marbury is upset because he believes he has the right to the job he was promised, and the new administration won’t give it to him.

  • William Marbury, frustrated that he hasn’t received his commission, decides to sue James Madison, Jefferson’s new Secretary of State. Marbury argues that the law guarantees him the position, and he demands the Court force Madison to deliver it. Madison refuses, saying the appointment isn’t valid, and the case is brought before the Supreme Court.
  • I demand the commission be delivered. The law is on my side! I am sueing!
  • We must settle this dispute legally, under the constitution.
  • It's not as simple as that, Mr. Marbury. There are constitutional limits to these appointments.
