Lastly, The Missouri Compromise is unconstitutional because the fifth amendment states that no one can be deprived of life, liberty, property without due process of law. Slaves are property, so Congress cannot ban people from taking slaves into federal territory. This also means Congress cannot ban slavery in any federal territory
