- Historical Fact: Adams appointed "Midnight Judges" to maintain Federalist influence in the judiciary before Thomas Jefferson’s inauguration.

- William Marbury: "My commission was signed and sealed! I am a Justice of the Peace. Where is my paperwork?"
- James Madison: "President Jefferson has ordered me to withhold these. You won't be getting your job, Mr. Marbury."
- Historical Fact: Jefferson ordered Madison not to deliver the remaining commissions, leading Marbury to sue for a legal order (writ of mandamus) to force the delivery.
