- oh no! look that guy is getting arrested.
- 50 years for a final sentence!
- it seems this is where the 8th amendment comes into play.
- and 400,000 dollars for bail!
- just for stealing some gum!!
- The 8th amendment states that no cruel or unusual bails or punishments are used.
- This meaning that a punishment and bail like this is uncalled for this particular case.
- this case reminds me about the case with Christopher Simmons, who was a 17-year-old boy who was supposed to be executed.
- but at the time since he was a minor the judges agreed that this was to cruel of a punishment and decided he will not be executed.
- but how does that violate his rights?
- and speaking on these facts he already did a lot of jail time, so his sentence is almost up.
- oh, I get it now!
- well, it violates his rights because since he is a minor, he still has a whole life ahead of him. and with the things he did it didn't call for such a harsh punishment such as the death penalty.
