  • I want my job or I will sue!!!
  • William Marbury, one of the midnight judges, didn't receive his commission and sued President Jefferson, asking the Supreme Court to compel him to deliver the papers and allow him to take his position as a judge.
  • Slide: 2
  • Marbury deserved the job, but the Supreme Court ruled it couldn't force the president to hand over the commission. Tough luck, Bill.
  • John Marshall, a fair judge, ruled that while Jefferson likely wronged Marbury, it was unconstitutional for the Supreme Court to force the president to act. By declaring the Judiciary Act of 1789 unconstitutional, he strengthened the Court's power to review laws for constitutionality.

  • When Thomas Jefferson took office, he was upset with John Adams for appointing 42 new judges, known as "midnight judges," who were loyal to Adams' ideals and opposed Jefferson's plans. In response, Jefferson refused to send the commissions to some of these judges, effectively ignoring their appointments.
  • That's unconstitutional!!!
