  • Hi. And yes I can. I understand your worry for them.
  • Hi! My friend was having surgery in room 102 and ive been worried about her, could you let me know how shes doing?
  • How is the patient doing? His friend would like to know!
  • The patient is doing great! We had minor complications but were able to fix them. We will come out and update you when we can.
  • Hi ma'am. I was coming in to let you know that your friend is doing good. He had some complications but they were able to fix it and he should be almost done.

  • The Scheduling assistant and patients friend were talking about getting updates on the patient. The assistant went into the surgical room and asked for a update. The surgeons proceeded to tell them.
  • The patient hasn't written a form stating that his medical information can be shared.
  • Was this a HIPAA violation? and if so, who was in the wrong?
  • Yes, this is a violation of HIPAA! All the doctors are at fault for this. The assistant proceeded to ask the surgeons, and the male surgeon told the assistant. The female surgeon didn't stop him from telling her the patients personal information.
  • In order to correct this violation, The scheduling assistant should have told the patients friend that the patients information is to be private unless he has signed a form stating that his information can be shared with her. The HIPAA rule goes to every medical facility and states that all medical information must stay private and cannot be seen by people unless they have permission. Any doctor who shares or opens medical information about anyone they don't have permission from, can get sued, fired, and can loose their medical license.
