This section provides a framework for the establishment and remuneration of a commission or committee where expenditure must be met by the Vote of the controlling department.
To ensure that non-officials serving on commissions and/or committees are remunerated according to the approved rates prescribed by National Treasury.
The risks which this chapter seeks to address or mitigate are: 1. Unauthorised appointment of committees or commissions. 2. Unauthorised appointment of committee members. 3. Members not qualified to serve on committees. 4. Incorrect remuneration to members.
Should the AO deem it necessary, he or she can, in consultation with the Executive Authority, determine other remuneration, provided that:(a) The ToR are properly defined in terms of time and cost; and(b) If applicable, the remuneration takes into account the tariffs as determined by the institute that regulates the profession to which the member belongs.
The remuneration of all members of a commission or committee must be disclosed as notes to the financial statements of the institution.
Should the Chairperson request a non-official member of a commission or committee to render services in his or her private time, other than the normal preparations for meetings, the person may be paid an honorarium (within the budget), as determined by the AO and the Executive Authority. In the case of official members, Section 30 of the Public Service Act, Act 103 of 1994, must be complied with.
A member not employed by the State must be remunerated according to scales approved by Treasury.
An official member may not receive additional remuneration. Subsistence and other allowances may be paid to the official member by the institution that employs the official member, in accordance with his or her conditions of service.
Remuneration of Commission or Committee Members
Appointment of Commissions or Committees Only the Executive Authority may appoint a non-standing commission and/or committee.The Executive Authority, in consultation with the AO, shall designate a member of a commission or committee as Chairperson.All external members appointed to a commission or committee must enter into a contract with the Department.
All subsistence and transport expenses incurred by a member while engaged in the work of a commissionor committee, the cost of any temporary assistance required by that member’s department by reasonof that member’s absence, as well as other expenses of a commission or committee (except the cost ofrecognised free services rendered by other departments) must be met from the Vote of the controllingdepartment.
