What is the Individual with Disabilities Education Act?
A special education law that means schools must evaluate students that may have a disability for free
Slide: 3
Is my son eligible?
To qualify for IDEA services, an evaluation must show that your son has a disability and needs special education to demonstrate growth in school
Slide: 4
So what are the benefits to IDEA?
The benefits include:1) It is free 2) The law makes sure that children are evaluated in an effective way3) With an Individualized Education Program (IEP), the student will have goals, accommodations, and modifications to their curriculum which helps make sure the student is learning4) Students are placed in the Least Restrictive Environment5) Children and Parents are protected. Parents and children are part of the team and IDEA makes sure the school follows through
Slide: 5
Wow! That's a lot of benefits. Are there any limitations?
The limitations include:1) Even with FAPE, you and the district may not agree on what is appropriate 2) For evaluations to be effective, the person doing the evaluation must be skilled and educators must be able to recognize what is best for students3) Since the IEP is audited, there is an incentive for educators to make sure students are meeting their goal. They may meet the goal on paper, but may need more work to demonstrate growth4) LRE can mean a lot of different things and the school and parent must work together to find out what is best for the student5) Parents must ask good questions to make sure the school is doing what is best for their student
Slide: 6
There are three questions that I like to think of. Here they are:1) Does the student have access to FAPE? This includes IEP goals that are challenging and make sense.2) Have you considered the input of the family?3) Is the child learning in the least restrictive environment?
Thank you! How could we advocate for students and families?
Slide: 7
1) Help students and families understand their rights under the law2) Help families with due process if they believe their child is not receiving FAPE3) Ask students and families what other support they need4) Always demonstrate good character and respect for diversity
How can we advocate for students and families?
