Hi, I have a question about medical records- The mother of one of my patients is requesting his medical records to be shared with her so she can see his test results. Could you tell me what I should check in this matter?
Not a problem. First check to see if his mother is an authorized person to view his medical records, second check the date when the consent was obtained and if it is still valid.

Yes I checked to make sure my patient had authorized his mother to receive medical records, which she was, but I did not pay attention to the expiration date.
That is very important. According to HIPAA privacy and security rules PHI of a patient may not be sent beyond a specific time frame

Additionally the risk analysis committee can release a PHI of patient without authorization / consent upon specific cases like child abuse, elderly neglect, public health law, if there is a detection of fraudulent activity.
