  • Under the Judiciary Act of 1807, Federalist President John Adams created the Midnight Judges. This was a small group of federalist judges created so that their party would have power in the courts.
  • Marbury Goes to Court

  • William Marbury, a businessman from Maryland applied to be a Midnight Judge and was accepted.

  • As a final step to becoming a Midnight Judge, Founder James Madison was supposed to deliver Marbury's commission so he could begin his new role. However Madison refused to deliver.
  • The Birth of Judicial Review
  • Its a Judicial Review!
  • Angered, Marbury decided to take the matter to court and asked for a Writ of Mandamus. This would require Madison to deliver the commission.
  • Chief Justice John Marshall decided that although Marbury was entitled to the commission, issuing a Writ of Mandamus was unconstitutional.

  • The outcome of the decision was Judicial Review, the ability of the courts to review congressional laws, actions taken by the president, and laws and actions of the states for constitutionality.
